This early morning between the hours of 3:00-4:00am I understand that the US agents of Immigration and Customs Enforcement (ICE) of the USCIS department of Homeland Security were banging on the doors of the place they supposed that I was staying at.

 

Before they deport me, seek to justify any treatment, and tell their stories, if at all, this is my story as told by me.

 

I never killed anyone; I offend a lot sometimes when I preach. I have never slept with anyone else since 1994, and no one else since I married my wife in the USA. I have been surely tempted by many even after my divorce/separation 2004. Since I became a preacher, I do not drink or smoke, when I try to taste wine and be like others, it makes me sick.

 

  • I was born 1963 in Makurdi
  • I went to primary school in Township Jos, Benue Plateau State graduated 1975
  • I went to secondary school at St. Joseph’s Vom, 1975-1980
  • Went to School of Basic Studies Ugbololo/Makurdi, 1980-1982
  • University of Benin 1983-1987
  • Nigeria Law School 1987-1988
  • Served Youth Service in Chief Kunle Abass (late) Chambers Ibadan 1988
  • Worked at Andzenge and Ge Law Office 1988-1992
  • Started my law firm, Akper & Ula-Lisa 1992-1998 when I left for the USA on a Multiple entry Visa (to preach the gospel).
  • I got born again (saved) in October 1994 with a call to preach the gospel in open vision, confirmed independently by various preachers who did not know me personally.
  • January, 1 1995 I got ordained by prophesy and the laying on of hands and the pouring with anointing oil in the New Years service at New Anointing Chapel Makurdi under the late Rev Godwin Ikyernum. The words were that God had ordained me to take the word to the nations and my plane would take off to the USA first. I preached everywhere, especially starting village churches until December 1997.
  • November-December 1997 shortly after the terrorist bombing of American tourists in Egypt, I was in Egypt representing Nigeria at the Democracy Conference organized by the British Council. I sat on a panel with Prof Awalu Yadudu and delivered a paper that castigated the West for their hypocrisy in applying democracy everywhere but in the Middle-East.
  • February 1999 I arrived the USA. I in NY for a week and had to leave for Wisconsin to meet my childhood friend. Within one month, my things were left at the church I preached at since I was only interested in preaching. I was dropped at Northview UPC on March 1, 1999 in the dead of winter.
  • I met a Caucasian lady at Northview United Pentecostal Church Milwaukee; she had three pretty children and yet was forlorn and always sat alone. I made friends with her. Her children loved my child-like ways and me. They had a new friend who played soccer with them.
  • The friendship blossomed and Esther ended up being my wife. Being two romantics, we had planned it for February 14, 1999, but we missed the date because I could not come up with the court fees so we wed in Waukesha Circuit Court on February 22, 1999.
  • We had kept our courtship secret because we realized the church was pretentious in preachments but segregating in acts and intentions. It was a ‘white church’ and once they discovered that we were interested in each other, I was told to leave.
  • I also delayed in deciding to marry Esther because I was engaged to another in Nigeria and did not wish to disappoint her. Esther kept visiting me in Milwaukee, sometimes with all her children.
  • I lived in Milwaukee and preached on the streets to drug dealers/smokers prostitutes and all manner of persons that would listen. When we married, I moved to Waukesha to be with Esther and now minister in Jail at Apostolic Life Tabernacle (name changed to Church).
  • We had large marital problems mostly to deal with my non-acceptance by her family, spirituality, money and the discipline of children. Suddenly, the person who was acknowledged as leading revival in the church became the enemy.
  • I was a stay at home dad, did the laundry, cooked food, swept and cleaned after Esther’s three children from February till September 1999 when I could work after a work authorization was issued to me. Esther had a $20,000 credit card debt; therefore, we hardly had money. I started work at Midwest Paralegals as a temp. Paralegal.
  • At one of our church pot-lucks, a jovial gent approached me, that he liked my British accent and was interested in me, asked what I did, how I did in Africa, and what kind of work I was searching for. I told him and gave him my resume.
  • One Friday evening I received a call from a lawyer who said that pot-luck gent had introduced me and asked if I wanted a job. We arranged for an interview at his office the next day at the downtown law office of Crivello Carlson Mentkowski and Steeves (as they were called then). I was hired on the spot asked if I could commence on Monday. Being on contract, I asked for time.
  • I commenced work in September only to realize that no work was assigned to me. Rather my boss encouraged me to research online and registered me to all kinds of websites. The computer operator took an undue interest in my computer and e-mails. I was followed everywhere including the toilet. When I complained in writing, I was fired.
  • The gentleman who introduced me, died by suicide-death, he was buried with military honors flag, gun-salute and all. I felt like I was being investigated.
  • Next I worked at Waukesha Brush Factory, where I noticed that at every break time, I noticed the smell of a stranger, I wrote a cheeky note and left in my locked car “Please when you have done doing all you came to do, remember to take your smell with you”. I was called at 7pm that Wednesday night and told by the agency that hired me that my services were no longer needed.
  • Next, I worked at the Compliance (legal) department of US Bancorp in Milwaukee. I sent e-mail to my wife that while we treat whites like kings in Nigeria, the apartment place treats us Africans as trash. I was fired that day.
  • In the interim, my mother-in-law had sworn she in concert with others would have me deported, that I married Esther to gain green card. Esther deposed to an affidavit before court to that effect.
  • As the children grew, they have had discipline issues. I was once arrested and arraigned for felony abuse of a child. My wife was subpoenaed to testify against me with the children, she was chased all over the city by police to force her testify. It was in the papers in Milwaukee. She was sent to jail for contempt when she wrote the judge that he should leave us alone and not seek to split homes. The judge quickly sealed the letter.
  • Before my trial in court for child abuse, I fired my court assigned lawyer in writing and told the court that I wanted to defend myself that I am a lawyer from a common law country. The judge refused to accede to my constitutional right to defend myself in person or by an attorney of myself. The attorney without authority entered into a plea-bargain on my behalf.
  • I later sought to set aside the process and the plea, I was denied access to court.
  • I left Waukesha to California to attempt the Bar exams. I was in Los Angeles from April until August 31, in a phone discussion with my wife, I told her that I was getting very frustrated since she was not allowing me concentrate on how to write the bar, that I was thinking it might be best if I relocated to Nigeria. That night, at an address known only by a few friends, I was served process for child support of my first daughter, without a divorce or separation from my wife.
  • On advise and with help from my pastor and friend, I went back to Wisconsin, and the states case crumbled when I deposed to an affidavit that I was not deposed or separated and had receipts of Western Union and phone transcripts.
  • Next, my pregnant wife files for divorce and when they came to serve on me, the Sheriff the police came to enforce that I left my home in Waukesha. I argue with them, their being no order to that effect until about 2:00 am when my Milwaukee pastor sends his son to get me.
  • I lived with my pastor and sued the State and its agents in Federal Court for violating my FHR. The suit was ongoing.
  • On February,6 2006, I booked a ticket online to visit Maryland to meet a Nigerian who was visiting. Coincidentally, the next day was the Senate hearing on domestic spying. On February 6 2006 Homeland Security wrote their letter canceling my work authorization and denying my change of status application that I could not prove a lawful valid marriage and sent it by Express mail (receipt acknowledged by my wife).

I, Eric Terfa Ula-Lisa, unemployed Nigerian lawyer of XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXdo hereby make oath and depose as follows:

 

  1. That I commenced this action PRO SE before this court to obtain substantial justice for the legal wrong done to me by defendants and to enforce my Fourth Amendment Rights under the constitution.

 

  1. Since I filed the suit, I have sought to retain counsel to represent me without any success; I even sought the assistance of the resident Federal District Attorney in Wisconsin to take over the discrimination part to no avail.

 

  1. Some of the unknown persons I sued were agents of the government, inclusive of Homeland Security and others in the secret search of and the seizure of my property and personal journal. (Para 12 – complaint); as well as Retaliation.

 

  1. On February 6, 2006, in Retaliation for this suit, Homeland Security wrote to me a letter denying my adjustment of status to a lawful resident based on my valid lawful marriage in Waukesha Court and canceling my work authorization, thus making it difficult for me to have means to prosecute my suit. (copy attached).

 

 

  1. I had since applied to reopen/Appeal but Homeland Security denies my application; I request protection from this court against retaliation.

 

  1. In April 2006, my benefactor, Pastor Clarence R. Hill Sr. died and so I was no longer made welcome at 5418 W. Burleigh St. Milwaukee.

 

  1. I have continued to suffer the harassment and illegal activity of the Homeland Security and the Department of Justice under the authority of Alberto Gonzales even as evinced in Senate Judicial Hearings.

 

  1. I seek justice here, and the motions to dismiss suit are attempts by Defendants to dodge the hearing, as counsel have not made any good faith efforts to contact me since I called both attorneys as soon as I received their papers.

 

 

  1. Being PRO SE, I had to fill a form provided as directed. I was not aware that I had to re-do the complaint. When the court directed me to serve the officers, I served them as soon as I could and filed the proof of service before the court on the same day, that is what brought counsel’s attention to suit to defend them.

 

  1. I am determined not only to prosecute my matter, I have demonstrated such, filed counter affidavits, Briefs of argument as well as attended Defendants Deposition and gave them documents requested in substantial compliance to the law. I am eager to also depose the State agents to find out their procedure as well as Attorney Frank Steeves to determine in what capacity he hired me and why I was not followed around like a spy.
